We are Magic Garlic, a company under the laws of Poland. We are makers of The Womber and Womber Arena. Our games are available via app stores including the Apple App Store and Google Play Store.

By using or otherwise accessing the Services, you agree to these Terms and our Privacy Policy. Make sure that you read them carefully before using the Services (our games).

You represent that you are at least 16 years old. If you are under age 16, you may not use our Services. If you are between the ages of 16 and 18, you represent that your legal guardian has reviewed and agrees to these Terms and our Privacy Policy. If your child wishes to use our Services, you as the child's legal guardian must agree to these Terms and our Privacy Policy as a precondition to the child's use.

Subject to these Terms, Magic Garlic grants you a non-exclusive, non-transferable, non-sublicensable, limited right to use our Services for your own personal, non-commercial, entertainment purposes.

Games provided to you are licensed, not sold. The apps themselves, and all trademarks, copyright, database rights and other intellectual property rights in them, remain the property of Magic Garlic.

You may not copy or modify the games, any part of the games, or our trademarks in any way. You may not attempt to extract the source code of the apps, translate the games into other languages, or create derivative versions.

At Magic Garlic we do not collect your personal data; however, our advertising partners may use data to personalise ads for you, and we use third-party analytics providers to deliver our services, conduct analysis and research. Please read our Privacy Policy.

Purchases of Virtual Currency and/or Virtual Goods, whether bought with real-world money or earned via gameplay, are final and are not refundable, exchangeable or transferable. You may not purchase, sell or exchange Virtual Currency or Virtual Goods outside the Services.

Magic Garlic may control, manage, modify or eliminate Virtual Items at any time, with or without notice. Virtual Currency and Virtual Goods have no equivalent value in real money and do not act as a substitute for real-world money.

You agree to defend, indemnify and hold harmless Magic Garlic from and against any claims, suits, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) brought by third parties resulting from or relating to your use of any game or your violation of this Agreement.

You understand and agree that our Services may be terminated (in whole or in part) without notice to you, including for economic reasons due to a limited number of users continuing to make use of them over time. In such an event we are not obliged to provide refunds for Virtual Items or other items in connection with discontinued Services. We promise to provide our Services in accordance with the highest professional standards.

The Service is provided "as is" without warranties of any kind. You understand that our Services cannot be guaranteed to be error-free. You assume the risk of use; for minor users, the responsibility rests with their legal representatives.

Magic Garlic will not be liable for special, incidental or consequential damages or loss arising from use of, or inability to use, the Services, including but not limited to damage to property, loss of goodwill, device failure or malfunction, personal injury, or lost profits.

Any person who suffers from epilepsy should consult a doctor before playing. If you experience uncontrollable jerking movements, impaired vision, dizziness, muscular or visual spasms, loss of consciousness, disorientation, involuntary movements or convulsions while playing, stop playing immediately and consult your doctor.

We may update these Terms from time to time. You are advised to review this page periodically for changes. We will notify you of changes by posting the new Terms on this page; changes are effective immediately after they are posted.
